This is a translation. The Vietnamese text at /phap-ly/mien-tru-trach-nhiem prevails, except where the law requires the version more favourable to a consumer.
This document is XNK24's professional disclaimer. It explains the nature of each feature on xnk24.com and in the XNK24 Pro application: which results are AI-generated, where the data comes from, and what you need to check before relying on it.
Version 1.0, effective from 28/10/2026. This document forms part of the Terms of use.
Chapter I. General principles
Article 1. This document does not remove your rights
- This document describes the nature of the service so that you can use it properly. It does not exclude or limit any right that the law guarantees you, including consumer rights under the Law on Protection of Consumers' Rights (Luật Bảo vệ quyền lợi người tiêu dùng) 2023.
- This document does not exempt XNK24 from liability for XNK24's own faults, for example where the software does not work as described, or where XNK24 enters data into a Data Pack that differs from the stated source.
- Each party's responsibility, compensation and the limitation of liability (which applies only to Business Customers who have agreed) are set out in the Terms of use. If this document and the Terms of use differ, the interpretation more favourable to the Consumer applies.
Article 2. XNK24 is a reference tool; you are the decision-maker
- XNK24 provides software, reference data and training content. XNK24 does not provide legal advisory services, is not a customs agent, is not a tax agent and is not a party to a transport contract with you.
- When you make a customs declaration, you (or your customs agent) are the customs declarant and are legally responsible for the accuracy of the content declared and the documents submitted, under customs law. XNK24 does not send, file or sign any declaration on your behalf.
- Before using any result for a declaration, contract, payment or business decision, check it against the original text, official sources or a qualified person.
Article 3. AI-generated content
- XNK24 Pro uses a small AI model installed on your own machine. Answers, suggestions and summaries generated by AI can be wrong, incomplete or out of date, even when they look very confident.
- AI-generated content in the application is labelled "AI-generated" (Do AI tạo), with the reminder: "The AI assistant can be wrong. Check the original text before using it for a declaration, contract or payment." Text quoted verbatim from official sources does not carry this label.
- The quality of results depends on the data you provide. Blurry scans, incomplete documents or questions lacking information make results less accurate.
Chapter II. Each feature
Article 4. Dashboard
The figures on the Dashboard (Bảng điều khiển) are counted by the program from data on your machine and from installed Data Packs, not generated by AI. The reminder cards and Radar signals on this page are reference information.
Article 5. Chat with the AI assistant
- Answers are generated by AI on your machine. The assistant has no Internet access, so it knows only what is in the installed Data Packs, the documents you attach and your question.
- Beneath each answer is a verification strip: the program checks each of the AI's statements against the evidence actually available (lookup results, documents, your question) and displays a confidence level. The verification strip helps you see where to check; it does not guarantee the answer is correct.
- Explanations of law, tax or procedure in chat are general information, not legal advice for your specific case.
- Sanctions screening: the assistant compares names against the United Nations Security Council consolidated list and the US Department of the Treasury's SDN list (OFAC) held in the Data Pack. The pack may not yet have the latest version; name matching may miss matches (names spelled differently, transliterated names) or flag false matches; lists of other countries and organisations are not in the pack. The result is not a legal conclusion on whether you may or may not transact.
- Data on requirements by country may be sample data; sample data is clearly marked and is not to be used for decisions.
Article 6. HS lookup
- Code lookup and keyword search return verbatim text from the tariff schedule and HS nomenclature in the Data Pack, with the tax rate and effective date recorded in the pack.
- Guided classification: the AI only chooses among options available in the tariff schedule and does not write an HS code itself; the program ranks the candidates. The result is a suggestion for you to consider, like a practitioner's note, not a conclusion.
- XNK24's suggestions are not an advance ruling on classification by the customs authority. Only the customs authority issues such a ruling, at the declarant's request. When it does not accept the code you declare, the customs authority has the power to decide the classification.
- The Data Pack does not yet contain the complete HS explanatory notes and the classification documents of the customs authority. Part of the tariff schedule was loaded by machine and is labelled as awaiting human review. Check codes and tax rates against the current tariff schedule before declaring.
Article 7. Legal text lookup (Tra văn bản)
- Legal texts in the pack are taken from official published sources such as the Official Gazette (Công báo) and Government portals, with reference numbers, validity status and amendment relationships.
- Newly issued texts appear only after XNK24 compiles and releases an updated pack. The pack therefore may not yet contain the latest text, or its validity status may not yet be updated.
- A "consolidated version" is assembled by machine according to rules from the verbatim text of the amending documents, not written by AI, and is labelled: "Consolidated version assembled by machine from the verbatim text of the documents in the pack; for reference, not a substitute for the official consolidated text". Where an official consolidated text exists, the application shows whether the assembled version matches or differs from the official one.
- The "Ask the assistant to explain" (Nhờ trợ lý giải thích) button generates AI content under Article 5.
- Only texts published in the Official Gazette and official consolidated texts have official force of use. Check against that source before citing.
Article 8. Trade statistics (Thống kê XNK)
- Figures are taken from sources published by the Statistics Office and the Customs Department. Preliminary and final figures are distinguished.
- The publishing authority may revise figures after XNK24 has packaged them, and the pack may lag behind the latest published period.
- Forecasts are statistical calculations from past data, shown with a back-test error: "Statistical forecast from history, not a commitment. Always check the back-test error." A forecast is not business advice.
Article 9. Freight quotation (Báo giá cước)
- Quotations you save: totals and comparisons are calculated by the program from figures you enter or confirm. When you paste a quotation email, the AI proposes the fields; the program checks each figure and date against the text you pasted, marks anything not found, and saves only when you confirm. Review before saving.
- Reference rate tables: taken from rate tables supplied by partners and the public websites of freight forwarders; each card states the source and the publication or collection date. These are reference rates, not an offer, not an invitation to contract, and XNK24 is not the carrier. The actual rate is confirmed by the freight forwarder at the time of booking: "Rates collected from the web and partners, for reference only. Contact the forwarder to confirm the current rate."
- Buttons that open external rate pages (for example Freightos, Phaata) only open that page in your browser; see Article 17.
Article 10. Declaration (Tờ khai)
- The Declaration feature prepares a worksheet of the fields you need to enter into the customs declaration software, each value accompanied by its source document. It is a drafting support tool; it is not the filing of a declaration and not a customs agency service.
- A field is marked "Fill" (Điền) only when the value appears verbatim in a document; the other fields carry a "Check" (Kiểm tra) mark and need your attention. The cross-check shows which values conflict between documents. The choice of HS code, value, origin and all final declared content is yours.
- The code tables used for the declaration software are labelled with version and date; when the declaration software or the customs authority changes the code tables, the tables in the application may be out of date until the next update.
Article 11. Radar
- Radar is a compilation of early signals from public domestic and foreign news. AI on XNK24's side groups the news and writes in Vietnamese; the figures are counted by the program. Each signal states its source.
- The short advice for each user group is general suggestion that does not take account of your own circumstances, and is not investment advice, legal advice or business advice.
- The "flagged N days ahead" (báo trước N ngày) label is recorded by the program according to rules when Vietnamese-language news about the same event appears later. This label describes the past; it does not guarantee that Radar will give advance warning of future events. The original news may be wrong or corrected after Radar has compiled it.
Article 12. Bulletin (Bản tin)
The daily audio Bulletin has a script written by AI from public news and a synthetic voice (the two presenters are virtual voices, not real people). Each episode has a list of sources and key points. The content goes through a check on XNK24's side before release but can still be wrong; open the original source when you need to rely on the information.
Article 13. Articles (Bài viết)
Articles on the xnk24.com blog and in the Articles section of the application are compiled by XNK24 with AI assistance. Articles give general information as at the date of posting, state the posting date, and may no longer be correct when regulations change. Articles are not advice for a specific case.
Article 14. Hỏi đáp (Q&A community)
- Questions, answers and comments in Hỏi đáp are written by members. XNK24 is not the author and does not moderate before posting; the content does not reflect XNK24's views.
- An accepted answer, scores and reputation points show the community's opinion; they do not confirm that an answer is correct and are not a certification of competence.
- If you see content that is unlawful, in violation or infringes your rights, report it under the Community rules; XNK24 reviews and handles it under the procedure there.
Article 15. Notebook (Sổ tay)
The content of the Notebook is written by you and stored on your machine. The template libraries pre-built on first run are reference content compiled by XNK24 and may not reflect the latest regulations.
Article 16. Skills (Kỹ năng)
- Lessons are written in advance by XNK24; the explanations and Q&A within lessons are generated by AI on your machine. Quizzes are graded by the program against a prepared answer key.
- Training content reflects regulations at the time of writing and may be out of date. Scores, learning streaks and quiz results are for your own tracking only; XNK24 does not issue certificates.
Article 17. Third-party websites and services
- Some buttons open third-party web pages in your browser: freight rate pages (Freightos, Phaata), news sources in Radar, the Bulletin and Articles, and sources of texts and statistics.
- The application does not send your data to those pages. When you open them, the third party's terms and privacy policy apply. XNK24 does not control the content, prices or availability of those pages.
- The names Freightos, Phaata, ECUS and other names are used only to refer to the owners' products; XNK24 has no partnership with or sponsorship from them, unless expressly stated.
Chapter III. What XNK24 does to reduce risk
Article 18. Measures in place
- The model proposes, the program decides. At important points, the AI may only choose among available options or propose a value, while the program checks and decides:
- the AI does not write HS codes itself; each option comes with a code and the verbatim tariff text, and there is always an "Other" (Khác) option;
- a declaration field is marked "Fill" only when it appears verbatim in a document;
- figures in a quotation are checked against the text you pasted and are not saved until you confirm;
- quizzes in Skills are graded by the program against a hidden answer key; the AI only narrates the result.
- Verbatim quotation with sources. Legal texts, tariff schedules and statistics are displayed verbatim with reference numbers, effective dates or data periods; machine-assembled consolidated texts are clearly labelled as assembled by machine.
- Verifying statements. Answers in chat have a verification strip showing which statements have evidence.
- Figures calculated by the program. Quotation totals, statistics, forecasts and error margins, and figures on the Dashboard and Radar are calculated by the program, not by AI.
- Digitally signed Data Packs. The application installs a pack only when the signature matches; a pack that downloads incorrectly or has a wrong signature leaves the old pack in place.
- AI labels and check reminders on all AI-generated content (Article 3).
Article 19. Reporting errors to XNK24
- If you see data in a pack that is wrong against its source, a text that is missing or no longer in force, or a tax rate that does not match, send it through the Support section in the application or by email to cto@xnk24.com. State the feature and the related text reference number or code. Do not attach documents or customer data.
- XNK24 gives a first response within 02 working days. If an error is confirmed, XNK24 corrects it in the earliest possible Data Pack update.
- The "Correct/Incorrect" (Đúng/Sai) rating buttons under an answer are stored on your machine; XNK24 receives these ratings only when you turn on the performance measurement feature (Privacy policy and personal data processing notice). To report an error, use clause 1.
