Acceptable use policy

This is a translation. The Vietnamese text at /phap-ly/su-dung-duoc-phep prevails, except where the law requires the version more favourable to a consumer.

This Policy forms part of the Terms of use. Capitalised terms have the meanings defined in Article 2 of the Terms of use. Content posted on Hỏi đáp (Q&A community) must also comply with the Community rules.

Chapter I. Scope

Article 1. Who and what it applies to

This Policy applies to all users of the xnk24.com website, the XNK24 Pro application, Data Packs, AI Output and Hỏi đáp, including during a trial or on the Free Plan.
You are responsible for use of the Service under your account, including use of the Service by others on your machine or account with your consent.

Chapter II. Prohibited conduct

Article 2. Using the Service to break the law

You must not use the Service, AI Output or Data Packs to commit, prepare or conceal a violation of the law, or to help others do so.

Article 3. Customs, trade and origin fraud

You must not use the Service or AI Output to:

prepare, alter or falsify customs declarations, invoices, packing lists, bills of lading, contracts or other documents with untrue content;
deliberately misdeclare the HS code, value, quantity, type or origin of goods, or split or rename goods to evade tax or avoid regulatory controls;
prepare, falsify or alter certificates of origin (C/O), self-certify origin, or legitimise the origin of goods that are merely transshipped or simply assembled;
forge or alter seals, signatures, licences or specialised inspection results.

Article 4. Sanctions and export controls

You represent that you, the organisation you represent and the persons controlling that organisation are not named on any United Nations Security Council sanctions list, and are not named on any other sanctions or export-restriction list that applies to you (for example the SDN list of the US Department of the Treasury or the sanctions lists of the European Union, where the law applies to you or to your transaction).
You must not use the Service to carry out, prepare or conceal a transaction that violates sanctions or export-control rules that apply to you, including transactions with sanctioned individuals, organisations, vessels or places, or routing goods through a third party to avoid those rules.
The sanctions screening tool in XNK24 Pro is based on lists as published at the Data Pack's update date. Screening results are for reference only; you remain responsible for checking in accordance with the rules that apply to you.
If there is credible evidence that the representation in clause 1 is untrue or that clause 2 has been breached, XNK24 may suspend or terminate the account following the procedure in Article 38 of the Terms of use.

Article 5. Misuse of AI

In line with the Law on Artificial Intelligence (Luật Trí tuệ nhân tạo), you must not:

use AI Output or the AI models in the application to violate the law;
use the Service to create or spread content impersonating real persons or real events in order to deceive or manipulate in a way that causes serious harm;
use the Service to exploit the vulnerabilities of vulnerable groups;
use the Service to create or spread fake content that seriously threatens national security, public order or social safety;
remove or conceal the "AI-generated" (Do AI tạo) label, or XNK24's warnings or notices, in order to present AI Output as an expert's opinion, as the opinion of a state agency, or as an official document;
obstruct or disable the mechanisms in the application that allow people to check and verify AI Output.

Article 6. Prohibited content on Hỏi đáp

You must not post, share or send through Hỏi đáp and Support content that:

opposes the Socialist Republic of Vietnam; distorts or undermines national solidarity; incites violence, war or hatred between ethnic groups or religions;
is false and causes public alarm, harms socio-economic activity, or offends the honour, reputation or dignity of others;
is obscene, depraved, criminal, superstitious, or damaging to fine customs and traditions;
discloses state secrets, the business secrets of others, or the personal information of others without their consent;
consists of customer documents, invoices, schedules, declarations or counterparty information (yours or anyone else's);
infringes intellectual property rights, is unlawful advertising or fraud, or is other content that the law prohibits.

Article 7. Interfering with the software and licensing

You must not, and must not help others to:

reverse engineer, decrypt, disassemble or analyse machine code to find the source code of XNK24 Pro, the adapted AI models or Data Packs, except where the law permits this and the right cannot be excluded by agreement;
modify, patch, create derivative works of, or distribute a modified version of the application;
alter, forge, copy or share licence files, digital signatures or account-status confirmations;
bypass, disable or distort the licence check, the one-device limit, the device-change limit, the 7-day offline limit, or the Data Pack download gate, including by turning back the machine clock, spoofing the machine identifier or selectively blocking connections;
try to activate or use unlock mechanisms, hidden modes or unpublished features;
interfere with, falsify or block the recording of Integrity Signals.

Open-source components in the application are used under each component's own licence, at Third-party licences. Good-faith security research within the scope and conditions of Article 5 and Article 7 of Security and vulnerability reporting is not treated as a violation of this Article.

You must not:

share, lend, rent, sell or transfer an account, a Pro Plan or the right to use a machine;
resell, sublicense or provide the Service to others as a service of your own, without a written agreement with XNK24;
create multiple accounts to take the trial repeatedly, or register using disposable email addresses or the email addresses of others;
use one machine for multiple accounts to avoid limits, or keep switching machines so that several people share one Pro Plan.

Article 9. Automated data harvesting

You must not:

extract, copy or bulk-export data from Data Packs, legal text lookup (Tra văn bản), HS lookup, Trade statistics, Reference rate tables or Radar, in accordance with clause 1 of Article 33 of the Terms of use;
use robots, crawlers, automated scripts or AI agents to access or bulk-download xnk24.com content (including the blog, Hỏi đáp, the Bulletin, Radar, Data Packs and AI models), other than search-engine indexing in accordance with the robots.txt file of xnk24.com;
use data or AI Output obtained from the Service to train or fine-tune AI models or to build a competing product;
redistribute AI model files downloaded from xnk24.com without complying with the model's original licence (see Third-party licences), or under the XNK24 name or trademarks.

Article 10. Attacking or harming the systems

You must not:

gain unauthorised access to, scan for vulnerabilities in, or attempt to attack XNK24's servers, APIs or databases or another person's account, outside the scope set out in Security and vulnerability reporting;
overload or disrupt the Service, send abnormal volumes of requests, or exceed or evade rate limits;
upload, send or spread malware, viruses or harmful files through Hỏi đáp, Support or any other channel;
harvest the email addresses or information of other members;
send spam or mass advertising through Hỏi đáp or Support.

Article 11. Impersonation

You must not impersonate XNK24, XNK24 staff, a state agency (such as the customs authority), or another person or organisation; must not claim to be a partner or agent of XNK24 without an agreement; and must not use the XNK24 name or trademarks to deceive others into transferring money.

Chapter III. Handling violations

Article 12. Measures

When there are signs of a violation, XNK24 reviews and handles the matter following the procedure in Article 38 of the Terms of use: staff review, notice to you, 07 working days for you to respond, and then a reasoned decision. In an emergency XNK24 may suspend immediately and give the reasons no later than 02 working days afterwards.
Measures are proportionate to the seriousness of the violation: a warning; removal of content on Hỏi đáp; restriction of a feature; suspension for a fixed period; termination of the account for serious or repeated violations.
You must compensate for actual damage caused to XNK24 or others as provided by law, including reasonable costs of preventing and remedying the damage, in accordance with Article 39 of the Terms of use.
XNK24 retains Integrity Signals, logs and related records as evidence for resolving complaints and disputes, in accordance with Article 39 of the Terms of use.
For violations of Article 7 and Article 8, XNK24 may refuse a new trial to the related account, email address or machine, in accordance with clause 4 of Article 23 of the Terms of use.
XNK24 may notify the competent state authorities and provide information on lawful request, as described in the Privacy policy and personal data processing notice.
Refunds for the unused part of the term when an account is terminated are handled under Article 18 of Payment, renewal, refund and trial policy.
You have the right to complain about a decision under Chapter X of the Terms of use.

Chapter IV. Reporting violations

Article 13. How to report

Content on Hỏi đáp: use the report button under the post, reply or comment. The content removal procedure is in the Community rules.
Security vulnerabilities: report under Security and vulnerability reporting.
Other conduct (such as account resale, distribution of cracked copies of the application, or impersonation of XNK24): email cto@xnk24.com or use Support, describing the matter and giving links or evidence if you have them.
XNK24 responds for the first time within 02 working days and keeps the reporter's identity confidential, unless the law requires otherwise.
